Step By Step

Step One
When you have found the house of your dreams and you wish to purchase it, all that remains are the legalities.Initially the terms of sale have to be agreed, written agreements signed by the seller and the buyer before that agreement is legally binding on both of them.

Step Two
Before this can happen the sellers Solicitors must prepare the agreements from information contained in the Deeds and send out those agreements with a number of other forms giving additional information, for example in relation to fixtures, fittings and contents at the house and also, if the seller has agreed to do so, the results of the Local Authority Search form obtained from the Local Council.

Step Three
It is then the buyers Solicitors reponsibility to make sure all these documents are in order and go through them with the buyer. In addition the property must be surveyed by the buyer, or if he is having a mortgage, by his Building Society Surveyor, and any necessary borrowing arrangements confirmed in writing.

Step Four
At that stage the buyer will then be able to commit himself to going ahead by signing the agreement and assuming that the seller is satisfied about his own moving arrangements ( this will probably mean having carried out similar procedures on any associated purchase he may have ) the seller will also sign. Solicitors acting for the seller and the buyer then agree to hand over signed agreements to each other so that the buyers Solictor then has an agreement signed by the seller and vice versa. At the same time the buyers Solicitor will pay over a deposit which is usually 10%, though sometimes less if for example the buyers mortgage is for more than 90% of the price. This handing over of agreements or 'Exchange of Contracts'

Step Five
Following 'Exchange of Contracts' the buyers Solicitors prepare a document which will actually transfer ownership of the property to the buyer as well as any mortgage forms including life assurance mortgage forms at the request of the Building Society. There are a number of further search enquiry forms for the buyers Solicitors to deal with in the run up to the 'Completion Date'. This is the date fixed in the agreement for the balance of the purchase price to be payed in return for which the sellers Solicitors will hand over the Deeds of the house and the keys of the property (although the keys are usually dealt with direct through the Estate Agents).
